    Family Trust issues involving the purchase of real estate can impose fiduciary duties on trustees to commence litigation, even when such litigation may not otherwise be in their best interest. Holding real estate in a family trust also exposes non-real estate trust assets to liabilities for the real estate in the trust. This includes real estate that must later be sold to 3rd parties with known problems.
